Terms of Service

1. Scope and acceptance

These terms govern access to and use of the Deklip service at deklip.com. They form a contract between you, the user, and Hugo Stawiarski, sole trader registered in France under company number (SIREN) 934 360 868, the operator. Creating an account constitutes unreserved acceptance of these terms and of the privacy policy. If you do not accept these terms, do not use the service. This English version is provided for information; the French version prevails in case of discrepancy.

2. Description of the service

Deklip is an online service that produces creative angles, scripts, short-form videos, visuals and post copy from a brief supplied by the user. It includes a video editor, a media library, publication scheduling and, for users who connect them, publishing to third-party social media accounts. The service relies on artificial intelligence models: results are probabilistic and vary between generations.

3. Account and eligibility

The service is reserved for adults with full legal capacity. An account is personal: you are responsible for keeping your credentials confidential and for all activity carried out from your account. Information provided at sign-up must be accurate and kept up to date. The operator may refuse, suspend or close an account in the event of manifestly false information, impersonation, or breach of these terms.

4. Credits, plans and pricing

The service runs on credits. Each billable action (angle set, video, clip, avatar, re-render, voice, music, subtitles) consumes a number of credits displayed before you confirm. The up-to-date breakdown is published on the Pricing page. Credits are obtained by purchasing packs or through a monthly subscription that tops up a credit allowance at each renewal. Unused subscription credits are not carried over to the next cycle unless stated otherwise on the Pricing page. Prices are shown in euros, including tax for consumers. The operator may change prices: the new price applies from the following renewal, after at least 30 days' notice by email.

5. Payment and invoicing

Payments are processed by Stripe Payments Europe Ltd. The operator never has access to card numbers. Invoices are available at any time from your account area. If a payment fails, access to paid features may be suspended until the situation is resolved.

6. Term, cancellation and refunds

The subscription is monthly, with no minimum commitment, and renews automatically. You may cancel at any time from your account area: cancellation takes effect at the end of the current period, at no cost, and you keep access until that date. Credits already consumed are not refundable. Where a generation fails for technical reasons attributable to the service, the corresponding credits are refunded automatically.

7. Right of withdrawal

As the service supplies digital content immediately, by starting a generation you expressly agree that performance begins before the end of the statutory fourteen-day withdrawal period and you waive that right for services already performed, in accordance with article L221-28 of the French Consumer Code. The right of withdrawal remains available, within fourteen days, for a subscription under which no credit has been consumed.

8. Acceptable use

You may not use the service to produce or distribute content that is unlawful, hateful, defamatory, harassing, pornographic, violent, deceptive, or that infringes the rights of others. You may not impersonate a real person, produce content depicting minors, circumvent technical limits or quotas, resell access to the service without written agreement, scrape the service at scale, or use the service to train a competing model. The operator may suspend an account immediately in the event of a serious or repeated breach, and report manifestly unlawful content to the competent authorities.

9. User content and ownership

You retain ownership of the content you upload (briefs, text, images, videos, audio) and you warrant that you hold the rights necessary to use it. You grant the operator a non-exclusive licence, limited to the lifetime of your account, strictly necessary to host, process and return that content as part of the service. The videos and visuals you produce with Deklip belong to you and may be used commercially, including after your subscription ends. The operator does not use your content to train its own models or those of any third party.

10. AI-generated content

Content produced by the service is generated automatically and may contain inaccuracies, approximations, or unintended resemblances to existing works. It is your responsibility to review and verify it, and to ensure it complies with applicable law before publication, in particular advertising law, copyright, image rights, and the rules of each distribution platform. You are solely responsible for the content you publish.

11. Third-party platform connections

The service lets you connect social media accounts, including TikTok, in order to publish videos and review their statistics. This connection is optional, is made through explicit authorisation using the OAuth protocol, and can be revoked at any time from the Connections page of your account area or from the settings of the platform concerned. By connecting an account, you undertake to comply with the terms of service and community guidelines of that platform, in particular the TikTok Terms of Service and TikTok Community Guidelines. The operator is neither affiliated with nor sponsored by these platforms, has no control over their moderation, suspension or account removal decisions, and cannot be held liable for an interruption of their service or a change to their application programming interface.

12. Availability and changes

The operator uses reasonable efforts to keep the service available, without guaranteeing uninterrupted operation. Interruptions may occur for maintenance, updates, or because of a third-party provider. Features may change: if a substantial feature of a paid plan is removed, you will be informed by email at least 30 days in advance and may cancel at no cost.

13. Warranties and liability

The service is provided as is. The operator does not guarantee any commercial result, audience level or distribution performance. The operator is not liable for indirect damages, including loss of revenue, customers, data or reputation. In any event, and except in the case of gross negligence or wilful misconduct, the operator's total liability is limited to the amounts actually paid by the user over the twelve months preceding the triggering event. Nothing in these terms limits the rights granted to consumers by mandatory law.

14. Suspension and termination

The operator may suspend or close an account in the event of a breach of these terms, fraudulent use, non-payment, or an order from a competent authority. Except in an emergency or where legally required, prior formal notice is sent by email. Where an account is closed for breach, unused credits are not refunded. You may close your account at any time by writing to deklip.com@gmail.com.

15. Personal data

The processing of your personal data is described in the privacy policy, which forms an integral part of these terms. It sets out which data from your connected accounts is processed, for how long, and how to delete it.

16. Partner programme

Participation in the partner programme is optional and governed by specific terms, available from the partner area once an application is approved. In the event of conflict, those specific terms prevail over these terms in respect of commissions and payouts.

17. Changes to these terms

The operator may amend these terms. Any substantial change is notified by email at least 30 days before it takes effect. Continuing to use the service after that date constitutes acceptance. If you do not accept, you may cancel at no cost before the change takes effect.

18. Governing law and disputes

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first by writing to deklip.com@gmail.com. Under article L612-1 of the French Consumer Code, consumers may use a consumer mediator free of charge. Failing agreement, the dispute will be brought before the competent French courts. Consumers may also use the European online dispute resolution platform.
